In 2004, recreation access advocate Sharetrails.Org/BlueRibbon Coalition (ST/BRC) participated in and won the Supreme Court Case, Norton VS Southern Utah Wilderness Alliance, in which the Court ruled that “the Administrative Procedure Act only allows courts to examine government agencies’ failures to meet specific statutory requirements. A general complaint based on policy differences–like SUWA’s view that the off- road vehicles made the Wilderness Study Areas unsuitable for preservation as wilderness–could not be heard under the APA.” In layman’s terms – it helped us KEEP TRAILS OPEN! We have an unprecedented opportunity to do even more through the Presidents recent Supreme Court nominee, Judge Brett M. Kavanaugh (more here). We are currently in the middle of fighting three critical legal battles:

  1. (Ochoco (OR) Travel Plan lawsuit – where ST/BRC is defending a state-of-the-art OHV trail system against anti-access attack.
  2. Bi State Sage Grouse (CA-NV) lawsuit – where ST/BRC is going on offense to fight a backroom deal that excessively restricts OHV events
  3. CA Forests OSV Plans – where ST/BRC is playing a central role in fighting arbitrary snow depth restrictions in a leading edge application of Subpart C of the Travel Management Rule.
